§ 14-139. Purpose and intent.

  • (a)

    The town has identified preservation of the Butler Chain of Lakes and other lakes within the town as critical to maintaining the town's character and charm and phosphorous is commonly used in various forms of fertilizers for lawn and turf application.

    (b)

    The use of fertilizers containing phosphorous causes overgrowth of vegetation and algae in natural and artificial water bodies and basins, and such overgrowth of vegetation and algae damages the natural environment.

    (c)

    Therefore, there is a need by the town to restrict the use of phosphorous fertilizers to minimize the damage to the lakes caused by said fertilizers and said regulation would properly act to protect the health, safety, property and welfare of the citizens of and visitors to the town; and the town recognizes that regulating fertilizer by type would be relatively more effective than regulating by amount.

    (d)

    Purpose. The purpose of this article, in agreement with the facts, is to provide regulation of phosphorous-based fertilizers in order to minimize the negative effect said fertilizers have on the Butler Chain of Lakes and other lakes within the town.
