§ 20-55. Authority of police.

  • Members of the police department are hereby authorized to remove and shall cause to be removed any vehicle from any street or alley within the town, to a public garage or other place of safety, under the following circumstances:

    (1)

    When any vehicle is left unattended:

    a.

    On a sidewalk or bicycle path;

    b.

    In front of a public or private driveway;

    c.

    Within an intersection;

    d.

    On a crosswalk;

    e.

    Between a safety zone and the nearest curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless the town has indicated a different length;

    (2)

    When properly signposted, warning vehicle operators of the nature and hazard of such area, when any vehicle is left unattended:

    a.

    Within 20 feet of a driveway entrance to a fire station and on the side of a street opposite the entrance of any fire station within 75 feet of such entrance;

    b.

    Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic;

    c.

    On a private road or driveway, including, but not limited to a parking area, when the duration of the unattended parking or reasonable inquiry indicates that the owner of the vehicle is not on the premises and if the posted warning indicates the garage or other place where the vehicle if removed will be stored;

    (3)

    When any vehicle is left unattended at any place where official signs prohibit parking, stopping or standing;

    (4)

    When any vehicle is left unattended upon any street for any period of time longer than 48 hours in any district;

    (5)

    When a vehicle upon a street or alley is so disabled as to constitute an obstruction to traffic or the person or persons in charge of the vehicle are by reasons of physical injury or condition incapacitated to such an extent as to be unable to provide for its custody or removal;

    (6)

    When any vehicle is left unattended upon any street or alley, and is so parked illegally, or upon any bridge, viaduct or causeway or in any tube or tunnel where such vehicle constitutes an obstruction to the normal movement of traffic;

    (7)

    When any vehicle is parked on any parking facility or area designated or used in connection with the town hall, police station, or other facilities of the town in violation of the posted signs and the permitted uses;

    (8)

    When any vehicle has, on at least two prior occasions occurring within any 12-month period, been found stopped, standing or parked on any street or alley within the town in violation of a town ordinance, and whose registered owner has failed or refused to appear in the county court in response to an existing warrant, citation or summons for such offenses shall be again found parked on any street or alley within the town in violation of any town ordinance regulating the parking of vehicles.
