§ 36-22. Restrictions and prohibitions pertaining to boat operations and boat parking.

  • (a)

    Boats may not be operated or parked closer than 30 feet from public swimming areas, except where a dock or pier is between the boat and the public swimming area.

    (b)

    Boats may not be parked overnight, either by anchoring or beaching, on public property.

    (c)

    A boat parked overnight on public property or within 30 feet of a public swimming area may be removed, relocated, impounded, and stored by the town, and all costs thereof may be charged by the town to the owner as a condition to its return.

    (d)

    When a boat parked on public property constitutes a danger to public safety or a hazard to public or private property, as determined by the reasonable judgment of the town manager or the chief of police, the town may remove it, relocate it, impound it, store it, and charge to the costs of removal, relocation, impoundment, and storage to the owner as a condition to its return.

    (e)

    A person operating a boat may not:

    (1)

    Anchor or beach or park a boat on public property in a manner that jeopardizes other boats;

    (2)

    Tie lines to or hook anchors on trees, bushes, markers, walkways, posts, signs, or other objects on public property;

    (3)

    Cause or threaten to cause damage to other property or injury to persons on public property; or

    (4)

    In any way impede access to public piers, docks, swimming areas, slips, or other public property.

    A boat parked or operated in violation of this subsection is subject to removal, relocation, impoundment, and storage by the town, with all costs thereof to be paid by the owner as a condition to the return of the boat.
