§ 5.03.04. Water shortage plan.

  • (a)

    The in intent of this section is to set forth a town water conservation plan consistent with the applicable rules of the South Florida Water Management District and the county so as to provide for the safe and prudent use of a limited and valuable resource. Should the water management district declare a water shortage, the specific restrictions of the district shall apply within the town.

    (b)

    The provisions of the county code, article XVIII, sections 37-601 through 37-604, which is included as article VIII of this Land Development Code, shall apply within the town.

    (c)

    To further the conservation of water, the principles of xeriscape landscaping as set forth in section 6.06.03(a), shall be used in all new development or for new or replaced homes in the older sections of town.

    (d)

    Penalties.

    (1)

    Violation. Violation of any provision of the article shall be subject to the following penalties:

    First violation Notice of violation
    Second violation $25.00 fine
    Subsequent
    violations
    Fine not to exceed $500.00 and/or imprisonment in the county jail not to exceed 60 days

     

    Each day in violation of this article shall constitute a separate offense. The town, in addition to the criminal sanctions contained herein, may take any other appropriate legal action, including but not limited to emergency injunctive action, to enforce the provision of this article.

    (2)

    Enforcement. Every police officer having jurisdiction in the area governed by this article shall, in connection with all other duties imposed by law, diligently enforce the provisions of this article. In addition, the town manager may also delegate enforcement responsibility for this article to agencies and departments of the town government in accordance with state and local law.
