§ 28-80. Collection, disposal to be by town.

  • All refuse accumulated in the town shall be collected, conveyed and disposed of by the town or its designated agents, licensees, franchisees or contract representatives. No other person or entity shall collect, convey over any of the streets or alleys of the town or dispose of any refuse accumulated in the town except as follows:

    (1)

    This section shall not prohibit the producers of industrial wastes, or the owners of premises upon which industrial wastes have accumulated, from personally collecting, conveying and disposing of industrial wastes if such service is not provided by the town, subject however to the rules and regulations of the town.

    (2)

    This section shall not prohibit collectors of refuse which has been collected outside the town limits from hauling such refuse over town streets; provided such collectors comply with the provisions of this article and with any other governing law or ordinance of the town.

    (3)

    The town has the right to refuse garbage, trash or any other form of refuse service of any unusual or bulky item or to require the owner or producer of waste to reduce it to such size and weight as can be handled with available equipment.
