§ 20-3. Commercial vehicles; routes.

  • (a)

    No commercial vehicle with more than two axles or any tractor trailer combination shall be driven or allowed to pass over and upon the streets, highways and roads in the town boundaries and limits.

    (b)

    The term "commercial vehicles," as used in this section, means any motor vehicle designed or used principally for carrying things other than passengers. The term "commercial vehicles" includes is any motor vehicle having four or more wheels designed and/or equipped with a fifth wheel for the primary purpose of drawing a semitrailer which shall be attached or coupled thereto by means of such fifth wheel.

    (c)

    Deliveries within the town boundaries (not postal area) are excepted from this section.

    (d)

    The town manager may grant additional exceptions if the request therefor is in writing.

    (e)

    Vehicles and trailers exceeding 96 inches in width shall not use Main Street south of Park Avenue to Chase Road.

    (f)

    The town engineer or engineer consultant is hereby authorized to implement load and weight limit restrictions for town maintained roadways and intersections upon a determination by the engineer, supported by an engineering or traffic study, that a town maintained roadway or intersection, by reason of its design, deterioration, rain or other climatic or material causes, may be liable to be damaged or destroyed by motor vehicles, trailers or semitrailers which exceed load and weight limits prescribed by the engineer. In the event that the engineer makes such determination, then load and weight limitations may be imposed by the engineer causing to be posted notice of such limitations at conspicuous places at the terminals of all intermediate crossroads and road junctions within the section of the town maintained roadway or intersection to which the notice applies. After any such notice has been posted, the operation of any motor vehicle contrary to such posting shall, pursuant to F.S. § 316.555, constitute a violation of F.S. ch. 316. Nothing contained herein shall be construed to interfere with the right of the state department of transportation to establish detours over any such restricted town maintained roadways and intersections unless such load and weight limitation has been first approved by the state department of transportation.
